Terms and conditions

These General Terms and Conditions apply to all products and services offered by Asian Import, owned by Vandelanotte Bart (BE0829.429.677), with its registered office at Vanackerestraat 59 / Kloosterstraat 28, 8560 Wevelgem (Belgium).

By using our website, placing an order by phone, or purchasing in-store, the buyer explicitly agrees to these terms.

Article 1 – Definitions

1.1 Seller: Asian Import, Vandelanotte Bart – BE0829.429.677

1.2 Buyer: Any natural or legal person purchasing goods or services from Asian Import, online, by phone, or in person.

1.3 Product: All goods and/or services offered by Asian Import.

1.4 Special Conditions: Specific promotional terms (such as Zotte Zondag, auctions, or rentals) that apply in addition to these general terms.

Article 2 – Applicability

2.1 These General Terms apply to all offers and agreements with Asian Import.

2.2 Special conditions prevail where they differ from general terms.

2.3 By placing an order via the website, email, phone, or in-store, the buyer expressly accepts these terms.

2.4 The latest version is always available at www.asianimport.be/terms.

Article 3 – Product Information

All products are described with care and accuracy. Images and specifications are indicative and may differ from the actual product.

Handmade or natural products may vary in color, shape, or finish; such variations are not considered defects.

Temporary offers or limited stock are clearly indicated.

Article 4 – Ordering and Payment

Orders are processed only after full payment.

Online orders: select product, fill in details, choose shipping method, accept terms, and confirm order.

After payment, the buyer receives a confirmation email.

Payment methods: Bancontact, iDeal, Visa, MasterCard, bank transfer, or cash in-store.

All invoices are payable immediately.

For professional clients: 1% monthly interest + 10% flat compensation (min. €50) in case of late payment.

Prices include VAT, excluding shipping costs. Pricing errors are non-binding.

Article 5 – Promotions, Zotte Zondag & Auctions

5.1 Additional conditions: asianimport.be/hulp-verkoop-per-opbod.

5.2 Zotte Zondag 2025:

No reservations possible; valid only October 12 (online) and October 19 (in-store).

Not valid on previously ordered products.

Pick-up of online orders: October 15–18 during opening hours.

Online orders accepted from 7:00 to 23:00, payment required the same day; unpaid orders will be cancelled.

Free shipping not applicable.

Article 6 – Delivery

Delivery according to Incoterm Ex Works (factory), unless otherwise agreed.

Delivery is made to the address provided by the buyer; changes afterward are not possible.

Delivery date will be communicated once the order is ready.

Delays or transport damages are beyond Asian Import’s responsibility.

Pallet deliveries:

No fixed delivery time possible.

Delivery to door/garage, ground floor.

Driver does not assist with installation.

Any damage or shortages must be reported in writing within 24h, with photos. Claims submitted after this period will not be accepted.

Article 7 – Warranty & Conformity

Products are delivered as offered, except for obvious errors.

Goods purchased in-store must be inspected beforehand; no return or warranty afterward.

Items are sold in their current condition, including visible or hidden defects.

The legal warranty of conformity applies under Belgian law.

Risk transfers to the buyer upon delivery.

Normal wear or color fading due to environment is not considered a defect.

Article 8 – Right of Withdrawal (Consumers within the EEA)

Consumers have the right to withdraw from the contract within 14 days of receipt, without giving any reason.

Withdrawal must be notified in writing or by email using the [withdrawal form].

Returned products must be unused, undamaged, and in original condition.

Return costs are borne by the buyer.

Exceptions: custom-made products, promotional or clearance items, rituals, tickets, or gift vouchers.

Refunds are made within 14 days after approval, via the original payment method.

Article 9 – Liability

Asian Import is not liable for indirect, consequential, or post-delivery damage or loss.

Use of products or information is at the buyer’s own risk.

Minerals and energy-related products are not substitutes for medical treatment.

Maximum liability is limited to the order value.

Article 10 – Force Majeure

Asian Import cannot be held liable for force majeure (e.g., fire, strikes, illness, transport or delivery issues).

In such cases, the agreement may be suspended or terminated without compensation.

Article 11 – Intellectual Property

All texts, photos, logos, and designs are the property of Asian Import and protected by intellectual property rights. Use without written permission is prohibited.

Article 12 – Gift and Credit Vouchers

Vouchers are valid for 1 year, online or in-store.

Single-use only; no cash refunds.

Remaining balances expire after use or the validity date.

Article 13 – Privacy and Data Management

Your personal data is processed in accordance with our privacy policy, compliant with GDPR regulations.

Article 14 – Complaints and Disputes

Damage or delivery complaints must be immediately noted on the delivery slip and reported in writing within 24h with evidence.

Other complaints must be submitted within 48h after delivery or invoice date by registered mail.

Asian Import aims to respond within 5 working days.

Only Belgian law applies. Competent court: Kortrijk.

Article 15 – Final Provisions

If any clause is found invalid, the remaining provisions remain fully applicable.

Asian Import reserves the right to modify these terms at any time. The latest version applies from publication on the website.
