1. Definitions and Applicability

1.1 Seller: Asian Import, Vandelanotte Bart - BE0829.429.677 - Vanackerestraat 59 / Kloosterstraat 28, 8560 Wevelgem

1.2 Buyer: Any natural or legal person who purchases from us (online, by telephone or in person).

1.3 Product: Any goods and/or services offered by Asian Import.

1.4 These terms and conditions apply to every offer by Asian Import. Special conditions (such as promotions, bids or rentals) apply additionally.

Article 2 - Terms and conditions 


2.1. Our general terms and conditions apply to each offer of the seller. 


2.2. If, in addition to these general conditions, additional special conditions apply (Crazy Sunday, rental, auction sales...), the above also applies to those special conditions. 


2.3. Placing an order on the website mail, by phone or in the shop/warehouse. counts as express acceptance of our general conditions of sale which are always available via the website: https://www.asianimport.be/terms


Article 3 - Products 

3.1 Limited validity or conditions are expressly stated.

3.2 Handmade products may differ from photos; this does not constitute a defect.

3.3 Images and product data are purely indicative and may differ from reality.

 

Article 4 - Order 

4.1 Orders are processed after payment.

4.2 For online purchases: place product in shopping basket, fill in details, choose shipping method, accept terms and conditions, and confirm order.

4.3 You will receive a confirmation by e-mail.

Article 6 - Prices & Payment

6.1 Prices include VAT, exclude shipping costs.

6.2 Shipping costs: Shipping Information

6.3 Price errors are not binding.

6.4 Invoices are payable immediately.

6.5 Payment methods: Bancontact, iDeal, Visa, MasterCard, bank transfer, cash.

6.6 For shops/wholesale: late payment is subject to 1% interest/month + 10% compensation (min. €50).

6.7. We reserve the right to change at any time the prices of products offered through our website and to correct any erroneous prices. 

Article 7 - Delivery

7.1 Delivery according to Incoterm Ex Works.

7.2 Delivery to the address provided. Change thereafter not possible.

7.3 Delivery date will be agreed as soon as the order is ready.

7.4 Delay or damage during transport is beyond our responsibility.

7.5 Pallet delivery:

- No time possible

- Delivery to front door/garage, first floor.

- Driver does not help with installation

- Report complaints within 24h in writing, with photos. complaints submitted after this time will not be considered.

Article 8 - Warranty & Conformity

8.1 We deliver according to offer, with exceptions in case of obvious errors.

8.2 Goods from store/warehouse must be checked in advance; no warranty or return.

8.3 Items are sold in current condition, including visible/hidden defects.

8.4 Damage upon delivery (Article 7) must be noted immediately on delivery document.

8.5 Risk passes to buyer upon delivery.

8.6 Color fading/wear due to weathering is not a manufacturing defect.

Article 9 - Force majeure 

We are not liable in cases of force majeure (strikes, fire, breakdowns, supply problems, etc.). 

We reserve the right to suspend or rescind the agreement.

Article 10 - Intellectual property 

All content (logos, photos, texts) is protected. Use without written permission is prohibited.

 

Article 11 - Data management / Privacy

Article 12 - Gift voucher/voucher 

12.1 Voucher is valid for 1 year (online or in store)

12.2 One time use, no cash-out.

12.3 Residual amounts expire

 

Article 13 - Liability

13.1 We are not liable for misuse or damage after delivery.

13.2 The information is informative and does not constitute binding advice.

13.3 Use of information or products is at your own risk.

13.4 Minerals are not a substitute for medical treatment.

 

Article 14 - Complaints and disputes 

14.1 Damage during transport? Only by direct written notification on delivery document.

14.2 Report visible defects within 24 hours, in writing and with proof.

14.3 Other complaints within 48h after delivery/invoice by registered letter.

14.4 Only Belgian law is applicable. Competent court: Kortrijk.

14.5 In case of dispute, only Belgian law is applicable. The court of Kortrijk has exclusive jurisdiction.

Article 15 - Right of withdrawal (Consumer - EEA)

15.1 You have 14 days of reflection time without giving any reason.

15.2 Report revocation via fully completed [form] and return to our address.

15.3 Conditions of return:

- Unused, undamaged, in original condition.

- Form enclosed

15.4 Refund within 14 days of approval, via original payment method.

15.5 Exceptions:

- Used/damaged/approved items.

- Custom items or orders upon request

- Tickets, rituals, promotions, end-of-series

- Gift certificates

15.6 Return charges are the responsibility of the buyer.
